This Privacy Policy was last updated on 30 September 2026.
Please read this policy carefully before browsing this website or using any of the services. Your continued use of this website indicates that you have both read and agree to the terms of this privacy policy.
1.1 For the purposes of this policy, Personal Information will be understood in accordance with the definition provided in the Protection of Personal Information Act 4 of 2013 (“POPIA”). FirstPathway Partners also subscribes to the principles for electronically collecting personal information outlined in the Act, and the further legislation referred to therein. We endeavour to ensure the quality, accuracy and confidentiality of Personal Information in our possession.
1.2 In adopting this Privacy Policy, we wish to balance our legitimate business interests and your reasonable expectation of privacy. Accordingly, we will take all reasonable steps to prevent unauthorised access to or disclosure of your Personal Information. However, it is impossible to guarantee that your Personal Information shall be 100% secure.
1.3 On becoming a client of FirstPathway Partners, clients will be prompted to sign a contract. In so doing, users may be asked to provide the following information (Personal Information):
1.3.1 First name;
1.3.2 Surname;
1.3.3 Email;
1.3.4 Physical address;
1.3.5 Phone number;
1.3.6 Company / CC / business name;
1.3.7 VAT number; and
1.3.8 Company registration number.
1.4 We will attempt to limit the types of Personal Information we process to only that to which you consent (for example, in the context of online registration, assessments, newsletters, surveys, professional announcements, SMS, WhatsApp and other mobile services), but, to the extent necessary, your agreement to this Privacy Policy constitutes your consent as voluntarily opting in for future communication.
1.5 We will not collect, use or disclose special personal information (such as information about racial or ethnic origin, or political or religious beliefs) except with your specific consent or in the circumstances permitted by law. Our online assessment does not ask for this information.
1.6 By agreeing to the terms contained in this Privacy Policy, you consent to the use of your Personal Information in relation to:
1.6.1 The provision and performance of the services;
1.6.2 Assessing your potential eligibility for the EB-5 Immigrant Investor Program and preparing for your consultation;
1.6.3 Informing you of changes made to our website;
1.6.4 The provision of marketing-related services to you by FirstPathway Partners;
1.6.5 Responding to any queries or requests you may have;
1.6.6 Developing an online user profile;
1.6.7 Understanding general user trends and patterns so that we can develop and support existing and ongoing marketing strategies; and
1.6.8 Security, administrative and legal purposes.
1.7 Although absolute security cannot be guaranteed on the internet, FirstPathway Partners has in place up-to-date, reasonable technical and organisational security measures to protect your Personal Information against accidental or intentional manipulation, loss, misuse, destruction or against unauthorised disclosure or access to the information we process online.
1.8 We store your Personal Information directly, or alternatively, store your Personal Information on, and transfer your Personal Information to, a central database.
1.9 Your information will not be stored for longer than is necessary for the purposes described in this Privacy Policy or as required by applicable legislation.
1.10 The Personal Information FirstPathway Partners collects from users shall only be accessed by FirstPathway Partners employees, representatives, and consultants on a need-to-know basis, and subject to reasonable confidentiality obligations binding such persons.
1.11 We will not sell, share, or rent your Personal Information to any third party or use your email address for unsolicited mail. Any emails sent by FirstPathway Partners will only be in connection with the provision of our services and/or the marketing thereof.
2.1 When you complete the free EB-5 assessment or request a consultation on this website, we collect the information you choose to give us, which may include:
2.1.1 Your first name, surname, email address and mobile number, and your preferred way to be contacted (WhatsApp, video call or phone call);
2.1.2 The country of your passport, your country of residence and your country of birth;
2.1.3 Which description best fits you (for example investor, parent, student or adviser) and your current United States immigration status, if any;
2.1.4 General information about your investment readiness: when funds could be available, the main source of the funds and when you would like to start. We do not ask for bank details, account numbers or financial documents through this website; and
2.1.5 Which family members would be included in an application, and whether any child is aged 18 to 20.
2.2 We ask for your passport, residence and birth country because United States visa numbers are allocated by country of birth, while your passport and residence affect how your green card is processed. Family and age information helps us identify timing issues, such as a child approaching 21.
2.3 We use this information to assess your potential eligibility, prepare for and arrange your consultation with Sonja Clarke, Director at FirstPathway Partners, send you information relevant to your situation, and contact you about the EB-5 program and FPP projects. You may ask us to stop contacting you at any time.
2.4 Your assessment is stored securely in this website’s database and sent by email to the FPP team handling your enquiry. It is only accessed on a need-to-know basis, as set out in clause 1.10.
2.5 An assessment is not an application, an offer of securities, or legal, tax or immigration advice.
3.1 FirstPathway Partners works with investors and advisers in many countries and with United States project partners. Your Personal Information may therefore be transferred to, and processed in, countries outside South Africa, including the United States. Where this happens, we take reasonable steps to ensure that the recipient is bound by laws, binding rules or agreements that provide an adequate level of protection, as required by section 72 of POPIA, or we transfer it with your consent or where the transfer is necessary to provide the services you have requested.
4.1 Subject to POPIA, you may at any time ask us to confirm whether we hold Personal Information about you and request access to it; ask us to correct, update or delete it; object to its processing, including for direct marketing; and withdraw your consent.
4.2 To exercise any of these rights, contact Sonja Clarke at sclarke@firstpathway.com. We may need to verify your identity before acting on a request.
4.3 If you are not satisfied with how we have handled your Personal Information, you may lodge a complaint with the Information Regulator of South Africa (inforegulator.org.za).
